Please read these Terms and Conditions carefully as they govern the relationship between you and us, and limits our liability to you when you purchase products from us. By accepting these Terms and Conditions you are forming a contract with us and agreeing to the Terms and Conditions that appear below. References to “you” and “your” are to you as an individual. References to “us,” “our” and “we” are to Total Health Is Natural, Inc.
1. Your Order
Each order placed by you with us shall be an offer by you to us to buy products subject to these and the website terms and conditions.
No order you place shall be deemed to be accepted by us until we have received payment in full.
You must ensure that the terms of your order, including the address for delivery, are complete and accurate. If you provide an inaccurate or otherwise undeliverable address and delivery cannot be made, you are responsible for the charge to re-ship your order.
All quotations and advertisements for products given on this website are given on the basis that no contract for sale shall come into existence between us and you until we have received payment in full from you. Any quotations or advertisements for products given on this website may be altered or withdrawn by us at any time.
We shall make an effort that all orders are met. We do not, however, guarantee the availability of any product at any time. When a product is temporarily out of stock, we will advise you of when we expect to be able to fulfill your order; however, this is an estimate only and shall not be binding upon us.
Once an order has been placed by you, accepted by us and shipped out of our offices, you cannot cancel the order. You will be responsible for any outgoing and return shipping charges.
We reserve the right to deny service or support to anyone who uses abusive or threatening language to our staff. Without exception, any client who engages in this behavior will automatically forfeit his or her right to our guarantee of support for our products and will be informed of such forfeiture by us in writing by Certified mail.
2. Shipping & Delivery
We ship all orders via USPS Priority Mail (2-3 day delivery to most states) from Acworth, GA. Shipping to all U.S. states and territories is a flat rate of $7.55 for orders totaling less than $100 and is FREE for orders of $100 or more. USPS Express shipping and shipping outside the United States will incur an extra flat-rate charge. Large items may incur a small shipping surcharge.
Please allow 24-36 hours (excluding Sundays and holidays) to receive an email notification from USPS.com that your shipping label has been printed. Orders received before 3:00 p.m. Eastern time Monday through Friday will ship same day. Orders received between 3:00 p.m. Friday and 10:00 a.m. Saturday, MAY be shipped on Saturday if the Post Office is open for business. Otherwise, orders received after 3:00 on Friday through 3:00 Monday will be shipped on Monday.
All products are well-packaged to eliminate breakage. Should there be any breakage during shipping you must contact us within 72 hours of delivery confirmation for replacement.
Delivery of the products shall take place at the delivery address contained in your order.
Any dates or times specified by us for delivery of the products are intended to be estimates only.
Subject to the other provisions contained in these terms and conditions, we shall not be liable for any direct, indirect or consequential loss (all three terms which include, without limitation, pure economic loss, loss of profits, loss of business, depletion of goodwill and similar losses), costs, damages or expenses caused directly or indirectly by any delay in the delivery of the products no matter what the cause.
3. Price and Payment
Unless otherwise agreed between you and us, the price for the products shall be the price advertised on the website as published on the date of the order.
Payment for the price of the products shall be due at the time of order.
Accepted forms of payment are VISA, MasterCard, Discover, and American Express. Should you require an alternative payment method, please contact us and we will make every attempt to accommodate special requests.
Orders to be delivered in the state of Georgia, by law, will incur the sales tax amount levied according to county.
Coupons and other discounts must be applied at time of purchase before the order is submitted and charged. Contact us prior to submitting your order if you encounter any difficulty applying a coupon or discount. Discounts that must be refunded AFTER placing the order will incur a $2.00 fee to cover our cost.
4. Returns and Refund Policy
Cancellations: Once an order has been submitted and the charge has been accepted, the order is considered completed. A completed order placed Monday through Friday after 3:00 p.m. E.T. and canceled after 7:00 p.m. E.T. (or an order placed on Saturday or Sunday before 7:00 p.m. E.T. and canceled after 7:00 p.m. E.T.) will incur 5% fee subtracted from the refund. This is the amount WE are charged to process your TWO transactions (the charge and the refund).
Incorrect Orders: In the event that the order you receive is incorrect or damaged, you must notify us by email, live chat, or phone call within 72 hours of delivery confirmation.
In the case of incorrect orders, the products shall be returned to us and we shall redeliver the correct order, both at our own expense. Damaged items will be replaced and we may require the damaged item to be returned to us at our expense. All order problems must be reported to us within 72 hours of delivery confirmation.
Returns & Refunds: With the exception of incorrect orders, you are responsible for all return shipping fees. We offer a 90-day refund policy for all unopened, original-seal-intact weight loss products, including all prepackaged Plans and Kits, as follows:
· Weight loss product returns received by us within 30 days from original delivery confirmation (the date on which the package was delivered to you) will be refunded 100% minus the greater of $5 or the actual cost of shipping.
· Weight loss product returns received by us 31-60 days from original delivery confirmation (the date on which the package was delivered to you) will be refunded 50% minus the greater of $5 or the actual cost of shipping.
· Weight loss product returns received by us 61-90 days from original delivery confirmation (the date on which the package was delivered to you) will be refunded 25% minus the greater of $5 or the actual cost of shipping.
· Weight loss product returns received by us 91 days or more from original delivery confirmation (the date on which the package was delivered to you) are not eligible for any refund.
· There is no refund on free products or free offers. For example, where 3 bottles are returned from an original order of "3 bottles plus 1 free bottle," the refund will be for 2 bottles. The third returned bottle is considered the free bottle, as we do not give free samples.
Except where noted on an individual product page, returns of unopened, original-seal-intact non-weight-loss-product store items will incur a 15% restocking fee, plus the actual cost of shipping, and must be received by us within 30 days from original delivery confirmation (the date on which the package was delivered to you). Returns of non-weight-loss-product store items returned unsealed or received after 30 days are not eligible for a refund.
ALL returns MUST be sent using Delivery Confirmation. This is for YOUR protection, as we cannot be responsible for the tracking or receipt of any packages without confirmation of delivery to us. Within 48 hours of receiving your return (Monday through Friday), we will send you an email confirming receipt of the package and the amount of refund.
Any refund due by us to you will be credited back within 7-10 business days to the pay method used at time of ordering. In the event that payment method is no longer valid, we will issue a company check within 10 business days. Otherwise, refunds cannot be made to a payment method other than the one used for purchase.
